No charges in fatal Export shooting, DA cites self-defense

GREENSBURG, Pa. — The Westmoreland County District Attorney’s Office has announced it will not pursue criminal charges in the June 18, 2024, shooting death of Daniel Chicka, 65, following an altercation in the Borough of Export.

The decision comes after a comprehensive investigation by the Pennsylvania State Police and a detailed review by prosecutors, including District Attorney Nicole W. Ziccarelli. Authorities concluded that Matthew Miller, Chicka’s neighbor, acted in self-defense during the fatal incident on Madison Avenue.

According to video evidence reviewed by investigators, Chicka was engaged in a verbal dispute with Miller before he pulled out a firearm and pointed it in Miller’s direction. Miller then responded by firing multiple rounds from his own firearm, striking Chicka.

“The legal right of individuals to protect themselves and others from imminent serious bodily injury is recognized under the law,” Ziccarelli stated. “I am profoundly sorry for Mr. Chicka’s family’s loss; however, I am committed to resolving cases based upon the facts and the law.”

The District Attorney’s Office expressed condolences to Chicka’s family but emphasized that the decision was based on clear evidence and legal principles.
