TRENTON, N.J. — The New Jersey Division of Alcoholic Beverage Control (ABC) issued a notice clarifying the state’s laws regarding firearms in bars and restaurants, following recent legal developments and changes in firearm legislation.
According to the advisory, carrying firearms into establishments where alcohol is sold or consumed is prohibited under Public Law 2022, Chapter 131, signed by Governor Phil Murphy in December 2022. This law applies to all individuals, including those with carry permits, except for law enforcement officers or individuals specifically authorized by the licensee to provide security on the premises.
The law’s enforcement has been influenced by legal challenges. A U.S. District Court judge issued a temporary restraining order in January 2023, blocking several provisions, including those prohibiting firearms in bars and restaurants. However, the Third Circuit Court of Appeals stayed the ruling in June 2023, reinstating the ban while the case continues.
State law currently designates bars and restaurants as “sensitive areas,” where firearms are not permitted. The ABC has urged licensees to post “Gun Free Zone” signs at their primary entrances to inform patrons. Free “Gun Free Zone” stickers are available through the Attorney General’s Office and can be requested via the ABC website.
Patrons found carrying firearms in violation of the law face criminal penalties and possible revocation of their carry permits. Licensees are advised to contact local law enforcement if violations occur and to take reasonable measures to prevent firearms on their premises.
