ROCKVILLE, Md. — An FBI special agent who was previously acquitted of attempted murder in a high-profile Metro train shooting has been charged with sexually assaulting two women, according to police and court records. The agent, Eduardo Valdivia, was arrested in Montgomery County, Maryland, on Monday and has been suspended by the FBI pending the outcome of the investigation.
“The FBI takes allegations of criminal violations and misconduct very seriously,” the bureau said in a statement to WUSA, a CBS affiliate. “We are aware of the matter involving the recent arrest of an FBI employee and are fully cooperating with the Montgomery County Police Department. Because this is an ongoing investigation, the FBI cannot comment further.”
The arrest comes nearly two years after Valdivia was acquitted of attempted second-degree murder and other charges related to a 2020 off-duty shooting on a Metro subway train near Washington, D.C. During that incident, Valdivia shot and injured a man following what authorities described as a verbal altercation. A Maryland jury cleared Valdivia of all charges, including first-degree assault and reckless endangerment, after he claimed he acted in self-defense.
Following the shooting, the injured man was reported to be in stable condition, according to Washington Metro Area Transit Authority police. Valdivia, who was arrested several weeks after the incident, surrendered voluntarily to local authorities and was released on personal recognizance with no objections from prosecutors.
Valdivia now faces new legal challenges as the Montgomery County Police Department investigates the allegations of sexual assault. Further details about the alleged incidents have not been disclosed.
