Appellate Court Rules in Favor of Kars4Kids in Trademark Dispute
NEWARK, NJ — National nonprofit Kars4Kids secured a victory in the Third Circuit Court yesterday, ending a lengthy trademark dispute against America Can Cars for Kids. The appellate court’s decision reaffirmed Kars4Kids’ rights to fully use its name and advertising methods in Texas, effectively overturning a prior monetary award.
Kars4Kids’ COO, Esti Landau, expressed satisfaction with the court’s acknowledgment of the nonprofit’s brand recognition across the country. The ruling permits Kars4Kids to continue leveraging its well-known jingle and brand in its charitable activities in Texas and nationwide. The organization’s president, Robert Moskovits, highlighted that the legal win allows them to focus on maximizing the benefits from car donations for their charity programs.
The dispute, which commenced in 2014, concluded with the court validating Kars4Kids’ exclusive right to utilize the Kars4Kids and 1-877-KARS-4-KIDS names and jingle across the United States. This decision allows the organization to move past the litigation and concentrate on its charitable work.
