PHILADELPHIA, PA – Attorney General Michelle Henry has filed a lawsuit against Delaware County’s Real McKoy Auto Sales, LLC, and its owner, Ervin McKoy. The lawsuit alleges the used vehicle dealer repeatedly violated automotive and consumer protection laws.
The Office of Attorney General is seeking to prohibit further vehicle sales by the dealer in Pennsylvania. This legal action follows a previous lawsuit against Real McKoy for operating without required licenses. The current suit accuses the dealership of failing to disclose vehicle issues on “as-is” sales and not providing title documentation to buyers.
Numerous consumers reported that vehicles purchased from Real McKoy broke down or were deemed unsafe shortly after purchase. One buyer cited a vehicle overheating due to a poorly repaired engine hole the day after a $5,000 purchase. Another was unable to register their car due to missing title documentation.
The lawsuit seeks a permanent injunction to stop the defendants from selling motor vehicles in Pennsylvania, restitution for affected consumers, and civil penalties for each violation of the Consumer Protection Law, including higher penalties for violations involving consumers aged 60 or older.
Previously in 2016, the Philadelphia Court of Common Pleas addressed similar issues involving Real McKoy and Ervin McKoy. That case, resolved in 2017, required adherence to the Unfair Trade Practices and Consumer Protection Law.
