Smithtown Man Indicted for Drug Sale That Lead to Overdose Death

SMITHTOWN, NY – Keith DiBartolomeo, 51, of Smithtown, has been indicted for Criminal Sale of a Controlled Substance and additional charges related to the sale of cocaine that led to the death of one man and the near-fatal overdose of a woman. Suffolk County District Attorney Raymond A. Tierney announced the indictment, criticizing DiBartolomeo for not seeking help for the victims. “In a most cruel and callous display of disregard for human life, the defendant allegedly left two people without rendering aid or even calling for help,” said Tierney.

On January 21, 2023, Suffolk County Police responded to a Smithtown residence around 10:00 a.m., where they found an unresponsive woman suffering from a drug overdose and hypothermia. She was immediately transported to St. Catherine’s Hospital. Medical intervention was able to save the woman, whose body temperature had dropped to a perilous 82.8 degrees upon arrival at the emergency room.

During the course of their investigation, officers discovered the body of a deceased male in a back apartment of the residence. Suffolk County Crime Laboratory tests revealed that residue from two plastic baggies found at the scene contained cocaine and fentanyl, respectively.

Home surveillance footage showed that DiBartolomeo pulled the unconscious female victim from her car onto the driveway of the residence around 5:27 a.m. After a brief attempt to rouse her, he left her exposed to the elements and entered the residence. DiBartolomeo was seen again at 9:15 a.m., walking past the still-unresponsive woman before driving away. A separate tenant found the woman and called 911 at 9:54 a.m., which led to the discovery of the deceased male victim.

DiBartolomeo was arraigned on October 12, 2023, by Acting Supreme Court Justice Anthony S. Senft Jr. on multiple charges, including Criminal Sale of a Controlled Substance in the Third Degree and Reckless Endangerment in the Second Degree. He was placed under supervised release with GPS monitoring and is due back in court on October 31. He is being represented by Richard Kaufman, Esq.
