QUEENS, NY – Queens District Attorney Melinda Katz recently announced that Victor Mitchell, a 37-year-old man from Albany, NY, pleaded guilty to aggravated vehicular homicide following a fatal single-car accident that killed his 8-year-old son in August 2020.
Tests revealed Mitchell was under the influence of both alcohol and marijuana at the time of the crash.
Mitchell was driving on August 16, 2020, around 6:50 am, when his Acura collided with a telephone pole at Seagirt Boulevard and Beach Street. A police-administered breathalyzer test indicated Mitchell’s blood alcohol content was .118 percent, above the legal limit of .08 percent. A Draeger drug test also returned positive for THC, the active component of marijuana.
Mitchell is expected to be sentenced to between four and twelve years in prison on July 28, by Queens Supreme Court Justice Michael Aloise.
