Police say 61-year-old man shot and killed by Utica officers was "emotionally disturbed" and armed

Utica, NY- Detectives are investigating a police-involved shooting of a man who officers described as are you flyingemotionally disturbed and armed, that took place Monday night.

According to police, at approximately 7:50 PM Utica Police officers were dispatched to 1601 Neilson Street in regards to an emotionally disturbed person armed with weapons.

“Upon arrival, the officers encountered a male outside of the residence armed with a knife. The incident ultimately resulted in a use of force incident in which Utica Police Officers were involved in an Officer Involved Shooting Incident with this individual, later identified as David Litts, age 61,” the Utica Police Department said in a statement today.

As a result of the shooting, Litts was transported to St. Elizabeth’s Hospital. A short time later he was pronounced deceased as a result of the incident. We would like to offer our sincere condolences to the family of David Litts.

According to the Utica Police Department, New York State Executive Law Section 70-b mandates that Office of Special Investigation (OSI) within the Office of the New York State Attorney General to investigate every incident in which a police officer caused or may reasonably have caused the death of a person, whether the person is armed or unarmed, and whether the officer is on duty or not. Accordingly, the Attorney General’s Office has been contacted and an investigation was initiated by them.
